A N     A C T

RELATING TO MOTOR AND OTHER VEHICLES -- MISCELLANEOUS RULES

It is enacted by the General Assembly as follows:

SECTION 1. Sections 31-22-13 and 31-22-14 of the General Laws in Chapter 31-22 entitled "Miscellaneous Rules" are hereby amended to read as follows:

31-22-13. Abandoned vehicles. -- The owner {ADD , or person having custody and control as authorized by the owner, ADD} of any motor vehicle who abandons the same {ADD as defined by section 31-42-1 ADD} on any public or private property other than his or her own, without the permission of the owner or lessee of the property {ADD in cases of private property ADD}, {DEL upon complaint by the owner or lessee to the registrar of motor vehicles DEL} shall be liable for all costs and expenses incurred by the owner {ADD , ADD} {DEL or DEL} lessee {ADD , ADD} or the state {ADD or any municipality ADD} in the removal of the vehicle from public or private property. Failure to pay the expenses within thirty (30) days of written notice shall be punished by a fine upon conviction, not in excess of {DEL one hundred dollars ($100) DEL} {ADD two hundred dollars ($200) ADD}, and {ADD thereupon ADD} the {DEL registry DEL} {ADD registrar of motor vehicles shall be notified and ADD} shall suspend the license and registration of the last registered owner of the abandoned vehicle until such expenses are paid {DEL , and no appeal from the conviction shall operate to stay the suspension DEL}.

31-22-14. Towing -- Costs paid by owner. -- {ADD (a) ADD} The owner {ADD , or person having custody and control as authorized by the owner, ADD} of any motor vehicle which is towed away from {DEL a public highway DEL} {ADD any public roadway ADD} because it is in violation of a state law or city or town ordinance, {ADD or which is towed from the scene of an accident or breakdown, or which is towed as the result of the lawful detention of an unlicensed operator, including those operating after denial, suspension, or revocation of license, ADD} shall be liable for the cost of towing, storage, and other incidental expenses in connection with said towing.

{ADD (b) The owner or operator of this section shall be responsible for the towing, storage and incidental expenses and for the towing or transportation fees to a demolisher or crusher and any crushing preparation fees associated with gas tanks, auto fluff, and battery acid and tire removal which exceed the salvage value of the vehicle. ADD}

{ADD (c) Any owner or operator who should fail to pay the costs and expenses set forth in this section within thirty (30) days of the receipt of written notice from the tow company, police department or demolisher shall be punished by a fine upon conviction not in excess of two hundred dollars ($200). ADD}

SECTION 2. Section 8-18-10 of the General Laws in Chapter 8-18 entitled "State and Municipal Court Compact" is hereby amended to read as follows:

8-18-10. Exclusive jurisdiction. -- The universal summons shall also be used for any violations of those sections not listed in section 8-18-3; provided, however that the following violations shall remain the exclusive jurisdiction of the administrative adjudication court or the state courts and shall not be within the jurisdiction of any municipal court:
