It is enacted by the General Assembly as follows:
SECTION 1. Chapter 23-28.22 of the General Laws entitled "Flammable and Combustible Liquids" is hereby amended by adding thereto the following sections:
{ADD 23-28.22-20. Closure of underground tanks. -- ADD} {ADD All underground tanks having contained flammable, combustible or explosive substances shall be closed and/or removed in accordance with the American Petroleum Institute Recommended Practice--1604, 2nd Edition, as amended. ADD}
{ADD 23-28.22-21. Tank cutting on site prohibited. -- ADD} {ADD No tank, as covered under this chapter, shall be cut on site. If any tank must be cut on site due to certain conditions, it shall only be done with the final approval of the state fire marshal and shall be done in accordance with section 23-28.22-20. ADD}
{ADD 23-28.22-22. Tanks stored and destroyed at tank yards. -- ADD} {ADD All tanks to be removed as provided by this chapter, shall only be moved to, stored, and destroyed at tank yards or safe areas approved by the state fire marshal and shall be done in compliance with section 23-28.22-20. ADD}
{ADD 23-28.22-23. Transportation of tanks. -- ADD} {ADD All tanks covered under this chapter, shall be transported in accordance with state and federal department of transportation regulations. ADD}
{ADD 23-28.22-24. Rules and regulations. -- ADD} {ADD The state fire marshal is hereby authorized to formulate and administer rules and regulations relating to the provisions of this chapter which shall be enforced in accordance with section 23-28.22-2(a). ADD}
SECTION 2. This act shall take effect upon passage.
