It is enacted by the General Assembly as follows:

SECTION 1. Chapter 11-4 of the General Laws entitled "Arson and Fires" is hereby amended by adding thereto the following section:

{ADD 11-4-2.1. Arson -- Custody. -- ADD} {ADD Any person who knowingly while under arrest or incarcerated, causes, procures, aids, counsels or creates by means of fire or explosion, the damage or destruction of any occupied or unoccupied building shall be guilty of arson in the first degree and shall be sentenced as provided in section 11-4-2. ADD}

SECTION 2. This act shall take effect upon passage.
