It is enacted by the General Assembly as follows:

SECTION 1. Section 23-33-27 of the General Laws in Chapter 23-33 entitled "Elevators, Escalators and Dumbwaiters" is hereby amended to read as follows:

{ADD 23-33-27. Fine for noncompliance. -- ADD} The lessee or owner or owners of any building, or, in case the lessee or owner, or any of them, be non compos mentis or a minor, the guardian of any such lessee or owner, or in case the lessee or owner, or any of them, be a nonresident, the agent of any such lessee or owner, having charge of such property, who shall neglect or fail to comply with the provisions of {DEL sections 23-33-22 to 23-33-27, inclusive, DEL} {ADD this chapter ADD} shall be fined {DEL not less than five dollars ($5.00) and not more than ten dollars ($10.00) DEL} {ADD in accordance with the provisions of section 23-33-20 ADD} for each day that an elevator {ADD or other devices ADD} shall be used or operated in the building contrary to the provisions of {DEL those sections DEL} {ADD this chapter ADD} . In case there shall be several such lessees or owners or agents in charge of any building in which an elevator {ADD or other device ADD} shall be used or operated contrary to the provisions of {DEL sections 23-33-22 to 23-33-27, inclusive, DEL} {ADD this chapter ADD} proceedings may be had against any or all of them jointly, or against any one of them, for the recovery of the fine.

SECTION 2. This act shall take effect upon passage.
