S E N A T E R E S O L U T I O N
CREATING A
SPECIAL SENATE COMMISSION TO STUDY MUNICIPAL PENSIONS

RESOLVED,
The Senate finds that within the State of
municipalities participate in the State of
certain municipalities have a municipal pension plan that
does not participate in the State of
the state's annual budget expenditure as well as the
state's economy as a whole. As such, the
General Assembly finds that
in order to provide the citizens of the State of
highest level of financial accountability while protecting
the public employee's right to accrued
pension benefits it is necessary to conduct a comprehensive
review and study of municipal
pensions within the State Pension System and those municipal
pension plans not participating in
the State Pension System; and be it further
RESOLVED,
That a special Senate commission be and the same is
hereby created
consisting of five (5) members: one of whom shall be the Senate
Majority Leader; one of whom
shall be the Senate Minority Leader; one of whom shall be
the Chair of the Senate Committee on
Finance; and two (2) of
whom shall be members of the Senate, to be appointed by the President
of the Senate.
In
lieu of any appointment of a member of the legislature to a permanent advisory
commission, a legislative study commission, or any commission
created by a General Assembly
resolution, the appointing authority may appoint a member of the
general public to serve in lieu
of a legislator, provided that the Majority Leader or
the Minority Leader of the political party
which is entitled to the appointment consents to the
appointment of the member of the general
public.
The
purpose of said commission shall be to make a comprehensive study and analysis
of
all aspects of municipal pensions within the State of
funding, investments and management, eligibility, age of
retirement, benefits, contributions,
vesting, disqualification, review of any and all statutes,
rules or regulations pertinent to
municipal pensions, as well as a review and analysis of any and
all data which may assist the
commission in determining whether or not it would be in the best
interest of the citizens of the
State of
whatsoever, whereby the taxpayers of the State of
savings through enhanced efficiencies, economies of scale
and/or streamlined operations.
Forthwith
upon passage of this resolution, the members of the commission shall meet at
the call of the Senate Majority Leader and organize and
shall select from among the legislators a
chairperson. Vacancies in said commission shall be filled in like
manner as the original
appointment.
The
membership of said commission shall receive no compensation for their services.
All
departments and agencies of the state shall furnish such advice and
information,
documentary and otherwise, to said commission and its agents as
is deemed necessary or
desirable by the commission to facilitate the purposes of this
resolution.
The
Joint Committee on Legislative Services is hereby authorized and directed to
provide
suitable quarters for said commission; and be it further
RESOLVED,
That the commission shall report its findings and
recommendations to the
Senate on or before June
30, 2010, and said commission shall expire on August 27, 1010.
