S E N A T E R E S O L U T I O N
CREATING A
SPECIAL SENATE COMMISSION
TO STUDY
R.I.G.L. § 23-17.14, THE HOSPITAL CONVERSION ACT

RESOLVED, The Senate finds that the
23-17.14 was enacted in
1997, and that since said enactment there has not been a comprehensive
review of the Act and its ramifications on the
Island
business economy. As such, the
Senate finds that in order to provide the citizens of the
State of
pricing it is necessary to conduct a comprehensive review and
study of the Act and any
amendments thereto; and be it further
RESOLVED,
That a special legislative commission be and the same
is hereby created
consisting of five (5) members: one of whom shall be the Senate
Majority Leader; one of whom
shall be the Senate Minority Leader; one of whom shall be
the Chair of the Senate Committee of
Health and Human Services;
one of whom shall be the Chair of the Senate Committee on
Corporations; and one of
whom shall be the Chair of the Senate Finance Committee.
In
lieu of any appointment of a member of the legislature to a permanent advisory
commission, a legislative study commission, or any commission
created by a General Assembly
resolution, the appointing authority may appoint a member of the
general public to serve in lieu
of a legislator, provided that the majority leader or
the minority leader of the political party which
is entitled to the appointment consent to the member of
the general public.
The
purpose of said commission shall be to make a comprehensive study and analysis
of
the efficacy and status of the Hospital Conversion Act,
R.I.G.L. § 23-17.14; study and analysis of
any economic impact to the health care industry since the
inception of the Act; review of any and
all statutes, rules or regulations pertinent to the Act,
as well as a review and analysis of any and
all data which may assist the commission in determining
whether or not it would be in the best
interest of the citizens of the State of
whatsoever.
Forthwith
upon passage of this resolution, the members of the commission shall meet at
the call of the President of the Senate and organize and
shall select a chairperson.
Vacancies
in said commission shall be filled in like manner as the original appointment.
The
membership of said commission shall receive no compensation for their services.
All
departments and agencies of the state shall furnish such advice and
information,
documentary and otherwise, to said commission and its agents as
is deemed necessary or
desirable by the commission to facilitate the purposes of this
resolution.
The
Joint Committee on Legislative Services is hereby authorized and directed to
provide
suitable quarters for said commission; and be it further
RESOLVED,
That the commission shall report its findings and
recommendations to the
Senate no later than June
30, 2010, and said commission shall expire on August 27, 2010.
