H O U S E R E S O L U T I O N
RESPECTFULLY URGING
THE PAWTUCKET CITY COUNCIL TO RESCIND THE IMPLEMENTATION OF THE AMENDMENT OF
CHAPTER 286 OF THE CODE OF ORDINANCES FOR THE CITY OF PAWTUCKET

WHEREAS,
On January 10, 2008 the Pawtucket City Council approved Chapter 2885,
an
amendment to Chapter 286 of the Code of Ordinances of the City of Pawtucket;
and
WHEREAS,
The amendment prohibits the use of “sound-amplifying” equipment at
outdoor
feasts and festivals after 10:00 p.m.; and
WHEREAS,
While the amendment was aimed at curtailing the festivities of one
particular
event, occurring only once a year, the scope of the restrictions have citywide
implications
and could potentially limit or curtail beneficial future activities, resulting
in
penalizing
innocent parties; and
WHEREAS,
Article I, Section 2 of the Rhode Island Constitution states, “All free
governments
are instituted for the protection, safety, and happiness of the people. All
laws,
therefore,
should be made for the good of the whole.” The good of the whole city cannot be
served
when laws are created for one event, occurring only once a year, in a small
neighborhood
of
the city; now, therefore be it
RESOLVED,
That this House of Representatives of the State of Rhode Island and
Providence
Plantations hereby respectfully urges the members of the Pawtucket City Council
to
set
aside the implementation of the Amendment of Chapter 286 of the Code of
Ordinances for the
City
of Pawtucket until further reconsideration of the facts are deliberated; and be
it further
RESOLVED,
That the Secretary of State be and he hereby is authorized and directed to
transmit
a duly certified copy of this resolution to the President of the Pawtucket City
Council.
