H O U S E R E S O L U T I O N
CREATING
A SPECIAL LEGISLATIVE COMMISSION TO STUDY ALL ASPECTS OF
VICARIOUS
LIABILITY PERTAINING TO AUTO-LEASING AND RENTAL COMPANIES IN THE STATE OF RHODE
ISLAND

WHEREAS,
Rhode Island law currently holds auto-leasing and rental companies
responsible
for vicarious liability on certain leased and rental motor vehicles in the
state; and
WHEREAS,
Automobile-leasing and rental companies are of vital importance to Rhode
Island’s
economy and growth; and
WHEREAS,
The financial burden imposed under the current law is creating an untenable
situation
for these auto-leasing and rental companies; now, therefore be it
RESOLVED,
That this House of Representatives of the State of Rhode Island and
Providence
Plantations hereby creates a special legislative commission to study all
aspects of
vicarious
liability pertaining to auto-leasing and rental companies in the State of Rhode
Island;
and
be it further
RESOLVED,
That a special House legislative commission be and the same is hereby
created
consisting of seven (7) persons who shall be members of the House of
Representatives,
not
more than five (5) from the same political party, to be appointed by the
Speaker of the House;
and
two (2) of whom shall be appointed by the Minority Leader of the House.
The
purpose of said commission shall be to make a comprehensive study of all
aspects,
including
the financial impact, of vicarious liability as it pertains to lessors, lessees
and renters of
motor
vehicle rentals in the State and to make recommendations relative thereto.
Forthwith
upon passage of this resolution, the members of said commission shall meet at
the
call of the Speaker of the House and organize and shall select, from among the
legislators, a
chairperson.
Vacancies in said commission shall be filled in like manner as the original
appointment.
The
membership of said commission shall receive no compensation for their services.
All
departments and agencies of the state shall furnish such advice and
information,
documentary
and otherwise, to said commission and its agents as is deemed necessary or
desirable
by the commission to facilitate the purposes of this resolution, including full
subpoena
power,
which may only be exercised with the prior approval of the Speaker of the House
of
Representatives
and President of the Senate.
The
Speaker of the House is hereby authorized and directed to provide suitable
quarters
for
said commission; and be it further
RESOLVED,
The commission shall report its findings and recommendations to the
Senate
no later than April 6, 2004 and said commission shall expire on June 6, 2004.
