RELATED TO CRIMINAL OFFENSES -- DISARMING A PEACE OFFICER

     

     Introduced By: Senators DiPalma, Tikoian, Dimitri, Appollonio, and LaMountain

     It is enacted by the General Assembly as follows:

     SECTION 1. Title 11 of the General Laws entitled "CRIMINAL OFFENSES" is hereby

amended by adding thereto the following chapter:

CHAPTER 71

DISARMING A PEACE OFFICER

5

     11-71-1. Disarming a peace officer.

6

     Any person who shall knowingly remove or attempt to remove a firearm, deadly weapon,

7

or less-lethal weapon to include, but not limited to, any blunt impact, chemical or conducted energy

8

device; or knowingly deprive or attempt to deprive the use of a mobile communication device,

9

radio or body worn camera, used in the performance of official duty, from the person of a peace

10

officer as defined in § 12-7-21, or investigator of the department of attorney general appointed

11

pursuant to § 42-9-8.1, shall be deemed to have committed a felony, and shall be imprisoned not

12

less than one year nor more than ten (10) years.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

RELATED TO CRIMINAL OFFENSES -- DISARMING A PEACE OFFICER

     This act would make it a felony for any person to remove or attempt to remove any firearm

2

or other weapon or any communication device from any peace officer or investigator of the

3

department of attorney general.

     This act would take effect upon passage.
