It is enacted by the General Assembly as follows:
SECTION 1. Chapter 45-6 of the General Laws entitled "Ordinances" is hereby amended by adding thereto the following section:
{ADD 45-6-11. Regulation of the practice of accupressure. -- ADD} {ADD (a) Every city or town, may by ordinance, license and regulate massage parlors and massage therapists as defined in section 23-10.8-1 and every person, corporation, and partnership in other businesses engaged in the practice of accupressure. ADD}
{ADD (b) Every city or town may establish such rules and regulations as are deemed necessary to carry out the purpose of this section. Provided, however, no ordinance may be enacted which is inconsistent with the provisions of chapter 23-20.8, "Licensing of Massage Parlors." ADD}
{ADD (c) Any such ordinance may provide for the suspension and revocation of licenses for violation of the ordinance or regulations. ADD}
{ADD (d) No ordinance enacted by a city or town shall apply to: ADD}
{ADD (1) The practice of massage by any person who is authorized to practice medicine, nursing, osteopathy, physiotherapy, chiropractic or podiatry in the state. ADD}
{ADD (2) The practice of that massage which is customarily given in barber shops or beauty parlors for the purpose of beautification by any licensed barber, hairdresser or cosmetician. ADD}
{ADD (3) The practice of massage by any person employed in a health care facility licensed or chartered by the state or enrolled in a program of a school or institute of massage approved by the board of regents. ADD}
{ADD (4) The practice of massage by any person duly employed as a trainer by a professional athletic association, club, or team, or as a member of the physical education department of an accredited university, college, or high school. ADD}
{ADD (5) The practice of massage by any person in a physical fitness facility as defined in section 23-20.8-1(3) operated by a corporation or association organized exclusively for the moral or mental improvement of men, women or children. ADD}
SECTION 2. This act shall take effect upon passage.
This act would authorize cities or towns to license and regulate the practices of massage and accupressure.
