A N   A C T

RELATING TO STATE ARCHIVES -- HISTORICAL RECORDS

It is enacted by the General Assembly as follows

SECTION 1. Section 42-8.1-20 of the General Laws in Chapter 42-8.1 entitled "State Archives" is hereby amended to read as follows:

42-8.1-20. Rhode Island Historical Records Trust established. -- (a) There is hereby established a special fund to be known as the Rhode Island Historical Records Trust (hereinafter called Trust).

(b) There is hereby imposed an additional assessment of {DEL two dollars ($2.00) DEL} {ADD three dollars ($3.00) ADD} for every instrument filed for recording pursuant to sections 33-22-21 and 34-13-7 of the general laws.

(c) On the first of every month, the municipal clerk shall transmit to the {DEL State Archives one half DEL} {ADD department of state two thirds (2/3) ADD} of the additional assessment collected under subsection (b) for deposit in the Rhode Island Historical Records Trust. The remaining {DEL one half DEL} {ADD one third (1/3) ADD} of each such additional assessment shall remain with the local government and be deposited in a local Historical Records Trust.

(d) All monies retained by a local government shall be placed in a Historical Records Trust Fund maintained by the local government. The expenditure of these monies shall be restricted solely to the preservation of public records of historical value maintained by the municipal clerk or by a municipal archives.

(e) {DEL Use of these funds by the State Archives DEL} {ADD One-half of the funds transmitted to the department of state pursuant to subsection (c) of this section ADD} shall be {DEL restricted solely DEL} {ADD allocated ADD} to the development and ongoing maintenance of {ADD the central voter registry to maintain records relating to the voter rolls pursuant to chapter 6 of title 17, which may include the acquisition of compatible computer systems in all cities and towns in the state; and the other one-half of said funds shall be allocated for ADD} a full-time local government records management program component within the state archives and records program. Such {ADD records management ADD} program shall be responsible for providing aid, advice, and assistance to all local governments of this State concerning the proper management and preservation of the public records in their custody or care, as required by other provision of statute. Funds shall be expended to support administrative and other costs associated with the provision of consultative and technical services including, but not limited to, educational programming, micrographics services, and ongoing storage and preservation of local government records.

(f) All monies received by the General Treasurer and other {DEL moneys DEL} {ADD monies ADD} appropriated or received for the purposes stated in subsection (b) shall be deposited in a restricted receipt account which shall be administered by the {DEL State Archives DEL} {ADD department of state ADD} .

(g) Each year the {DEL State Archives DEL} {ADD department of state ADD} shall review and make recommendations on a proposed operational and expenditure plan for the Rhode Island Historical Records Trust.

SECTION 2. This act shall take effect upon passage.
