RELATING TO MOTOR AND OTHER VEHICLES -- OFFENSES AGAINST

REGISTRATION AND CERTIFICATE OF TITLE LAWS

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-8-1.1 of the General Laws in Chapter 31-8 entitled "Offenses

2

Against Registration and Certificate of Title Laws" is hereby amended to read as follows:

3

     31-8-1.1. Operation of beach vehicle without permit.

4

     (a) No person shall operate, nor shall an owner knowingly permit to be operated, upon a

5

beach as defined by the coastal resources management council, any vehicle required to be registered

6

by the coastal resources management council unless there has been issued a valid beach registration

7

permit and unless there is attached on it and displayed on it a valid registration sticker issued by

8

the coastal resources management council for the current registration year. Any violation of this

9

section shall be punishable by a fine of not less that twenty-five dollars ($25.00) nor more than

10

seventy-five dollars ($75.00).

11

     (b) Violations of this section are subject to fines enumerated in § 31-41.1-4.

12

     SECTION 2. Sections 31-19-5, 31-19-6 and 31-19-19 of the General Laws in Chapter 31-

13

19 entitled "Operation of Bicycles" are hereby amended to read as follows:

14

     31-19-5. Clinging to vehicles.

15

     (a) No person riding upon any bicycle, coaster, roller skates, sled, or toy vehicle shall attach

16

it or himself or herself to any vehicle upon a roadway.

17

     (b) This section shall not prohibit attaching a trailer or semi-trailer to a bicycle if that trailer

18

or semi-trailer has been designed for this attachment.

     (c) Violations of this section are subject to fines enumerated in § 31-41.1-4.

     31-19-6. Bicycles to right of road.

3

     (a) Every person operating a bicycle upon a roadway shall ride as near to the right side of

4

the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding

5

in the same direction except where official traffic control devices (signs or pavement markings)

6

specifically direct bicyclists to do otherwise.

7

     (b) Violations of this section are subject to fines enumerated in § 31-4.1-4.

     31-19-19. Use of coasters, roller skates, and similar devices restricted.

9

     (a) No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or

10

similar device, shall go upon any roadway except while crossing a street on a crosswalk, and when

11

so crossing, the person shall be granted all of the rights and shall be subject to all of the duties

12

applicable to pedestrians. This section shall not apply upon any street while set aside as a play street

13

by a duly authorized police authority.

     (b) Violations of this section are subject to fines enumerated in § 31-41.1-4.

     SECTION 3. Section 31-41.1-4 of the General Laws in Chapter 31-41.1 entitled

16

"Adjudication of Traffic Offenses" is hereby amended to read as follows:

17

     31-41.1-4. Schedule of violations.

18

     (a) The penalties for violations of the enumerated sections, listed in numerical order,

19

correspond to the fines described. However, those offenses for which punishments may vary

20

according to the severity of the offense, or punishment that requires the violator to perform a

21

service, shall be heard and decided by the traffic tribunal or municipal court. The following

22

violations may be handled administratively through the method prescribed in this chapter. This list

23

is not exclusive and jurisdiction may be conferred on the traffic tribunal with regard to other

24

violations.

     (b) In addition to any other penalties provided by law, a judge may impose the following

33

penalties for speeding:

34

     (1) For speeds up to and including ten miles per hour (10 m.p.h.) over the posted speed

limit on public highways, a fine as provided for in subsection (a) of this section for the first offense;

2

ten dollars ($10.00) per mile for each mile in excess of the speed limit for the second offense if

3

within twelve (12) months of the first offense; and fifteen dollars ($15.00) per mile for each mile

4

in excess of the speed limit for the third and any subsequent offense if within twelve (12) months

5

of the first offense. In addition, the license may be suspended up to thirty (30) days.

6

     (2) For speeds in excess of ten miles per hour (10 m.p.h.) over the posted speed limit on

7

public highways, a mandatory fine of ten dollars ($10.00) for each mile over the speed limit for the

8

first offense; fifteen dollars ($15.00) per mile for each mile in excess of the speed limit for the

9

second offense if within twelve (12) months of the first offense; and twenty dollars ($20.00) per

10

mile for each mile in excess of the speed limit for the third and subsequent offense if within twelve

11

(12) months of the first offense. In addition, the license may be suspended up to sixty (60) days.

12

     (c) Except for a technology surcharge assessed in accordance with § 8-15-11, any person

13

charged with a violation who pays the fine administratively pursuant to this chapter shall not be

14

subject to any additional costs or assessments, including, but not limited to, the hearing fee

15

established in § 8-18-4.

     SECTION 4. This act shall take effect upon passage.

     This act would increase the fines for certain traffic offenses to one hundred dollars ($100)

2

and add fines of one hundred dollars ($100) for offenses required by law but omitted from the

3

schedule.

     This act would take effect upon passage.
