RELATING TO MILITARY AFFAIRS AND DEFENSE -- BURIAL OF VETERANS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 30-25 of the General Laws entitled "Burial of Veterans" is hereby |
2 | amended by adding thereto the following section: |
3 | 30-25-14.1. Eligibility for burial -- Members of special guerrilla units. |
4 | (a) Purpose. The general assembly finds that certain individuals, including Filipino and |
5 | Hmong veterans, served honorably with special guerrilla units or irregular forces operating in |
6 | support of the United States Armed Forces during the conflict in the Kingdom of Loas and |
7 | surrounding regions between 1961 and 1975, commonly known as the "Secret War." These |
8 | individuals fought alongside United States military personnel, sustained heavy casualties, and have |
9 | been recognized by acts of the United States Congress and the U.S. Department of Veterans Affairs |
10 | for their service. |
11 | (b) Eligibility. Any person who: |
12 | (1) Served honorably with a special guerrilla unit or irregular forces operations, including |
13 | Filipino and Hmong veterans as defined in 38 U.S.C. § 2402(A)(8) and 38 C.F.R. § 38.620 (h), in |
14 | support of the United States Armed Forces; and |
15 | (2) Has been determined by the United States Department of Veterans’ Affairs to be |
16 | eligible for burial in a national cemetery pursuant to 38 U.S.C. § 2402 and 38 C.F.R. § 38.620, shall |
17 | be deemed eligible for burial in the Rhode Island Veterans Memorial Cemetery (RIMVC), subject |
18 | to all other conditions and rules applicable to interment therein. The RIMVC may request a |
19 | determination from the Department of Veterans’ Affairs as to whether a person is eligible for burial |

1 | in a national cemetery under 38 U.S.C. 2402(a)(8) or 38 U.S.C. 2402(10) and may rely on that |
2 | determination in ascertaining eligibility for burial at the RIMVC. |
3 | (c) Documentation. The RIMVC may establish eligibility by accepting the same evidence |
4 | of service that the Department of Veterans’ Affairs requires to determine eligibility for interment |
5 | in national veterans’ cemeteries. |
6 | (d) Federal compliance. Nothing in this section shall be construed to expand eligibility for |
7 | burial beyond those categories recognized under federal law or to jeopardize the state’s receipt of |
8 | federal funds or grants for the operation or maintenance of the Rhode Island Veterans Memorial |
9 | Cemetery. |
10 | SECTION 2. This act shall take effect upon passage. |
