RELATING TO STATE AFFAIRS AND GOVERNMENT -- LEAD HAZARD MITIGATION | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 42-128.1 of the General Laws entitled "Lead Hazard Mitigation" is |
2 | hereby amended by adding thereto the following section: |
3 | 42-128.1-15. Lead hazard mitigation in building renovations. |
4 | (a) Any mill or other building built before the year 1978 that is being renovated for housing, |
5 | offices or any other purpose shall comply with the provisions of chapter 24.6 of title 23 ("lead |
6 | poisoning prevention act") and chapter 21 of title 28 ("hazardous substances right-to-know act"). |
7 | (b) Any person or firm performing any renovation project referenced in subsection (a) of |
8 | this section, shall register the project with the department of labor and training (DLT) prior to |
9 | beginning any work. |
10 | (c) Any person or firm performing any renovation project referenced in subsection (a) of |
11 | this section, shall be or have engaged, a lead contractor as that term is defined in § 23-24.6-4. |
12 | (d) Any employee of the person or firm performing any renovation project referenced in |
13 | subsection (a) of this section, shall be required to have a minimum of twenty-four (24) hours of |
14 | lead worker training in compliance with § 28-21-9. |
15 | (e) Any person or firm performing any renovation project referenced in subsection (a) of |
16 | this section shall have a lead work supervisor present and on site for a minimum of forty (40) hours |
17 | per week. |
18 | (f) DLT shall have authority to enforce all lead standards and ensure compliance with the |
19 | provisions of this chapter and with chapter 24.6 of title 23 and chapter 21 of title 28. |

1 | (g) Nothing in this section shall be construed to limit the enforcement powers of the |
2 | attorney general or of any private cause of action authorized by law. |
3 | SECTION 2. This act shall take effect upon passage. |

1 | This act would require all renovation projects of buildings built before 1978 for housing, |
2 | offices or any other purpose, to comply with the provisions of chapter 24.6 of title 23, the lead |
3 | poisoning prevention act and chapter 21 of title 28, the hazardous substances right-to-know act and |
4 | would require any project of renovation to have a lead inspector, lead training, a lead supervisor |
5 | and would require that the Rhode Island department of labor and training ensure compliance with |
6 | these provisions. |
7 | This act would take effect upon passage. |
