RELATING TO WATERS AND NAVIGATION -- PFAS IN DRINKING WATER,

GROUNDWATER, AND SURFACE WATER

It is enacted by the General Assembly as follows:

     SECTION 1. Section 46-32-7 of the General Laws in Chapter 46-32 entitled "PFAS in

Drinking Water, Groundwater, and Surface Waters" is hereby amended to read as follows:

     46-32-7. Investigation of potential sources of per- and polyfluoroalkyl substances

4

contamination.

     (a) On or before November 1, 2023, the director of the department of environmental

6

management shall publish a plan for public review and comment to complete a statewide

7

investigation of potential sources of per- and polyfluoroalkyl substances (PFAS) contamination.

As part of this investigation, the director of the department of health shall conduct a pilot project at

9

public water systems by an applicable analytical method to evaluate total PFAS the maximum

10

number of PFAS detectable from standard laboratory methods. The director of the department of

11

environmental management shall initiate implementation of the plan not later than January 1, 2024.

12

     (b) On or before June 1, 2024 2025, all public water systems in the state as defined in ยง 46-

13

13-2, except transient, non-community water systems as defined by the department of health in 216

14

R.I.C.R.-50-5-1 as may be amended, shall conduct monitoring of raw, untreated drinking water for

15

the maximum number of PFAS detectable from standard laboratory methods.

16

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

OF

RELATING TO WATERS AND NAVIGATION -- PFAS IN DRINKING WATER,

GROUNDWATER, AND SURFACE WATER

     This act would delay from June 1, 2024, until June 1, 2025, the necessity to conduct

2

monitoring for the maximum number PFAS in drinking water and would amend the type of water

3

systems to which the requirement applies.

4

     This act would take effect upon passage.
