RELATING TO TOWNS AND CITIES -- CITY HOUSING AUTHORITIES | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 45-25 of the General Laws entitled "City Housing Authorities" is |
2 | hereby amended by adding thereto the following section: |
3 | 45-25-15.2. Section 8 performance-based contract administration program. |
4 | (a) The Rhode Island housing and mortgage finance corporation is a public housing |
5 | authority and public housing agency authorized to administer housing assistance programs |
6 | throughout this state for the benefit of persons of low- or moderate-income, subject to the limited |
7 | exception in § 45-25-15.1. |
8 | (b) Notwithstanding any other provision of law, no other person, public housing authority, |
9 | or public housing agency, domestic or foreign, shall be authorized to administer allocations of |
10 | money under 42 U.S.C.A. § 1437f, or other federal statute authorizing project-based rental |
11 | subsidies under an annual contributions contract for the benefit of persons of low- or moderate- |
12 | income, on a statewide basis within this state, or on a regional basis that includes this state, except: |
13 | (1) The Rhode Island housing and mortgage finance corporation; |
14 | (2) A person authorized to administer such allocations pursuant to an agreement with the |
15 | Rhode Island housing and mortgage finance corporation; or |
16 | (3) An organization, of which the Rhode Island housing and mortgage finance corporation |
17 | is a promoter, member, associate, owner, partner, manager, or other joint venturer, that is authorized |
18 | by a federal agency to administer such allocations in this state. |
19 | (c) In addition to the powers granted by this chapter and chapter 55 of title 42, the Rhode |

1 | Island housing and mortgage finance corporation shall have all the powers necessary or convenient |
2 | for the administration of federal monies pursuant to subsection (b) of this section, including the |
3 | power: |
4 | (1) To enter into one or more agreements for the administration of federal monies on a |
5 | statewide basis; |
6 | (2) To be a promoter, partner, member, associate, owner, partner, manager, or other joint |
7 | venturer of any partnership, limited liability company, joint venture, association, trust, or other |
8 | organization; |
9 | (3) To conduct its activities, locate offices, and exercise the powers granted by this title |
10 | within or outside this state, in compliance with all applicable laws; |
11 | (4) To carry on a business in the furtherance of its purposes; and |
12 | (5) To do all things necessary or convenient, consistent with law, to further the activities |
13 | and affairs of the Rhode Island housing and mortgage finance corporation. |
14 | SECTION 2. This act shall take effect upon passage. |

2 | 1437f, regarding low-income housing assistance, to the Rhode Island housing and mortgage finance |
3 | corporation (RIHMFC) and related organizations and would spell out their powers in order to |
4 | further the activities and affairs of RIHMFC. |
5 | This act would take effect upon passage. |
