RELATING TO STATE AFFAIRS AND GOVERNMENT -- OFFICE OF HEALTH AND

HUMAN SERVICES

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 42-7.2 of the General Laws entitled "Office of Health and Human

Services" is hereby amended by adding thereto the following section:

     42-7.2-20.9. ABLE account program information.

     Beginning with the 2024-2025 school year, a school district shall provide informational

5

material about the achieving a better life experience (ABLE) account program established under ยง

6

42-7.2-20.3 to the parent or guardian of any student with an individualized education program (IEP)

7

at the student's annual IEP review meeting, whether held in person, held remotely, or held in any

8

other manner. The office of the general treasurer shall prepare the informational material and

9

deliver the informational material to the Rhode Island department of education who shall distribute

10

the informational material to school districts.

     A school may transmit the informational material to a parent or guardian in the same

12

manner as other documents or information related to an annual IEP review meeting are provided to

13

the parent or guardian.

     SECTION 2. This act shall take effect upon passage.

     This act would require school districts to provide the parent or guardian of a student with

an individualized education program (IEP) with information concerning the achieving a better life

3

experience (ABLE) account program benefits and the program application process.

     This act would take effect upon passage.
