RELATING TO STATE AFFAIRS AND GOVERNMENT -- 2024 REAPPOINTMENT OF

PERSONS SERVING IN POSITIONS REQUIRING ADVICE AND CONSENT ACT

     It is enacted by the General Assembly as follows:

     SECTION 1. Title 42 of the General Laws entitled “STATE AFFAIRS AND

2

GOVERNMENT” is hereby amended by adding thereto the following chapter:

CHAPTER 166

2024 REAPPOINTMENT OF PERSONS SERVING IN POSITIONS REQUIRING ADVICE

5

AND CONSENT ACT

     42-166-1. Short title.

7

     This chapter shall be known and may be cited as the "2024 Reappointment of Persons

8

Serving in Positions Requiring Advice and Consent Act."

     42-166-2. Definitions.

10

     As used herein:

11

     (1) “Appointee” means a person who has been appointed to a board, committee,

12

commission, or similar entity, whose appointment required or requires the advice and consent of

13

the senate.

14

     (2) “Board” means a board, commission, committee, or similar entity, at the state,

15

municipal, or other level, and which consists, either in whole or in part, of members whose

16

appointment to the board requires the advice and consent of the senate.

17

     (3) “Term of appointment” means the time period from when the appointee commences

18

the appointee’s service on the board by appointment, and the date on which the term of the

appointee is due to expire or has expired.

     42-166-3. Governor to provide names of appointees with expiring terms.

     (a) On January 1 of each year, or as soon thereafter as practicable, the governor shall

4

provide the senate with a list of all appointees to boards, commissions, committees, and similar

5

entities, whose appointment requires or required the advice and consent of the senate, and whose

6

term of office has expired in prior years or whose term is scheduled to expire during the then-

7

current calendar year.

     (b) Each entry on this list shall include:

     (1) The name of the appointee;

10

     (2) The name of the board(s) the appointee serves on pursuant to the advice and consent of

11

the senate;

12

     (3) The date of the appointee’s appointment;

13

     (4) The date of expiration of the appointee’s term on the board; and

14

     (5) Whether the governor intends to submit a replacement appointment, or nominate the

15

appointee for reappointment, by May 1 of the then same year.

16

     (c) The governor shall not need to include on this list persons serving on a board whose

17

membership on or appointment to that board does not require the advice and consent of the senate.

     42-166-4. Certain reappointments prohibited.

19

     If an appointee of a board continues to serve for one year or more after expiration of the

20

person’s term of appointment, without that person being nominated for reappointment by the

21

governor for advice and consent during that year, that appointee shall not be eligible for

22

reappointment to that same board in a capacity and position which requires the advice and consent

23

of the senate. This provision shall only apply to appointees serving on a board in a capacity and

24

position which requires the advice and consent of the senate.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

PERSONS SERVING IN POSITIONS REQUIRING ADVICE AND CONSENT ACT

     This act would direct the Governor to annually provide the Senate with a list of appointees

2

on boards and commissions, whose appointment required the advice and consent of the senate, and

3

whose term of appointment has either expired in prior years or is set to expire in the then-current

4

year.

5

     This act would take effect upon passage.
