RELATING TO TOWNS AND CITIES -- LOW AND MODERATE INCOME HOUSING | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 45-53 of the General Laws entitled "Low and Moderate Income |
2 | Housing" is hereby amended by adding thereto the following section: |
3 | 45-53-16. Public transportation requirement. |
4 | (a) Any municipality not provided with public transportation sufficient to extend to urban |
5 | service boundaries within the municipality shall be permitted to reduce the percentage of low- or |
6 | moderate-income housing required pursuant to this chapter from ten percent (10%) of the year |
7 | round housing units reported in the census to six percent (6%) of the year round housing units |
8 | reported in the census as provided for in the definition of "consistent with local needs" in ยง 45-53- |
9 | 3(4). |
10 | (b) The decision to issue the percentage reduction provided in this section shall be |
11 | determined by the approved monitoring agent. |
12 | SECTION 2. This act shall take effect upon passage. |
