RELATING TO EDUCATION -- TEACHERS' RETIREMENT

     

     Introduced By: Senators Burke, Pearson, Gallo, LaMountain, Bissaillon, Britto, and

     It is enacted by the General Assembly as follows:

     SECTION 1. Section 16-16-38 of the General Laws in Chapter 16-16 entitled "Teachers’

Retirement [See Title 16 Chapter 97 — The Rhode Island Board of Education Act]" is hereby

3

amended to read as follows:

     16-16-38. Social security.

5

     (a) All public school teachers hired on or after July 1, 2024, shall be required to participate

6

in the social security retirement system. Payroll taxes, in the form of benefit contributions made

7

under the federal Social Security Act, shall be deducted from their payroll checks.

     (b) Notwithstanding the above provision, Sections §§ 16-16-25 through 16-16-38 shall not

9

apply to teachers of any city, town, or regional school district who have elected coverage under the

10

federal Social Security Act, 42 U.S.C. § 301 et seq., under the provisions of chapter 7 of title 36.,

11

unless previously granted grandfather rights. The general treasurer is authorized and directed to

12

enter into or amend any agreement with the federal government that is necessary to implement the

13

provisions of this section, including, but not limited to, any agreement with the federal government

14

entered into pursuant to § 36-7-3.

     SECTION 2. This act shall take effect upon passage.

EXPLANATION

BY THE LEGISLATIVE COUNCIL

     This act would require all public school teachers hired on or after July 1, 2024, to

2

participate in the retirement system social security pursuant to chapter 7 of title 36.

3

     This act would take effect upon passage.
