RELATING TO INSURANCE -- ACCIDENT AND SICKNESS INSURANCE POLICIES | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 27-18 of the General Laws entitled "Accident and Sickness Insurance |
2 | Policies" is hereby amended by adding thereto the following section: |
3 | 27-18-95. Coverage for use of artificial intelligence in analysis of breast tissue |
4 | diagnostic imaging. |
5 | (a) Every individual or group health insurance contract, or every individual or group |
6 | hospital or medical expense insurance policy, plan, or group policy delivered, issued for delivery, |
7 | or renewed in this state on or after January 1, 2025, shall provide coverage for the use of artificial |
8 | intelligence technology for analysis of breast tissue diagnostic imaging; provided that, the breast |
9 | tissue diagnostic imaging and the review generated by artificial intelligence is independently |
10 | reviewed and approved of by a physician qualified to read and interpret breast tissue diagnostic |
11 | imaging. |
12 | (b) As used in this section: |
13 | (1) "Artificial intelligence" means the use of computers and technology to simulate |
14 | intelligent behavior, critical thinking, and analysis comparable to a human being. |
15 | (2) "Breast tissue diagnostic imaging" means mammograms, breast magnetic resonance |
16 | imaging ("MRI"), breast ultrasound, and molecular breast imaging. |
17 | SECTION 2. Chapter 27-19 of the General Laws entitled "Nonprofit Hospital Service |
18 | Corporations" is hereby amended by adding thereto the following section: |
19 | 27-19-87. Coverage for use of artificial intelligence in analysis of breast tissue |
