RELATING TO INSURANCE -- ACCIDENT AND SICKNESS INSURANCE POLICIES

     

     Introduced By: Representatives Fogarty, Tanzi, Donovan, Casimiro, Cotter, Carson,
Speakman, Henries, Caldwell, and Shallcross Smith

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 27-18 of the General Laws entitled "Accident and Sickness Insurance

2

Policies" is hereby amended by adding thereto the following section:

3

     27-18-95. Coverage for use of artificial intelligence in analysis of breast tissue

4

diagnostic imaging.

     (a) Every individual or group health insurance contract, or every individual or group

6

hospital or medical expense insurance policy, plan, or group policy delivered, issued for delivery,

7

or renewed in this state on or after January 1, 2025, shall provide coverage for the use of artificial

8

intelligence technology for analysis of breast tissue diagnostic imaging; provided that, the breast

9

tissue diagnostic imaging and the review generated by artificial intelligence is independently

10

reviewed and approved of by a physician qualified to read and interpret breast tissue diagnostic

11

imaging.

     (b) As used in this section:

13

     (1) "Artificial intelligence" means the use of computers and technology to simulate

14

intelligent behavior, critical thinking, and analysis comparable to a human being.

15

     (2) "Breast tissue diagnostic imaging" means mammograms, breast magnetic resonance

16

imaging ("MRI"), breast ultrasound, and molecular breast imaging.

17

     SECTION 2. Chapter 27-19 of the General Laws entitled "Nonprofit Hospital Service

18

Corporations" is hereby amended by adding thereto the following section:

     27-19-87. Coverage for use of artificial intelligence in analysis of breast tissue

diagnostic imaging.

     (a) Every individual or group health insurance contract, or every individual or group

3

hospital or medical expense insurance policy, plan, or group policy delivered, issued for delivery,

4

or renewed in this state on or after January 1, 2025, shall provide coverage for the use of artificial

5

intelligence technology for analysis of breast tissue diagnostic imaging; provided that, the breast

6

tissue diagnostic imaging and the review generated by artificial intelligence is independently

hospital or medical expense insurance policy, plan, or group policy delivered, issued for delivery,

22

diagnostic imaging.

     (a) Every individual or group health insurance contract, or every individual or group

BY THE LEGISLATIVE COUNCIL

     This act would provide that on and after January 1, 2025, health insurance plans issued in

the state would provide coverage the use of artificial intelligence technology for analysis of breast

3

tissue diagnostic imaging; provided that, the breast tissue diagnostic imaging and the review

4

generated by artificial intelligence is independently reviewed and approved of by a physician

5

qualified to read and interpret breast tissue diagnostic imaging.

6

     This act would take effect upon passage.
