RELATING TO HOLIDAYS AND DAYS OF SPECIAL OBSERVANCE -- WORK ON | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 25-3-2 of the General Laws in Chapter 25-3 entitled "Work on |
2 | Holidays and Sundays" is hereby amended to read as follows: |
3 | 25-3-2. Increased pay required for work on Sundays and holidays. |
4 | (a) Any person, association, or corporation receiving a permit from the division of racing |
5 | and athletics of the department of business regulation to operate any horse racing, dog racing, or |
6 | jai alai event under the parimutuel system and any person, association, or corporation doing |
7 | business under a contractual agreement to provide any services to any horse racing, dog racing, or |
8 | jai alai event under the parimutuel system shall compensate the necessary persons to conduct the |
9 | event on Sundays and/or holidays for at least one and one-half (1½) times the normal rate of pay |
10 | for the work performed, and it shall not be grounds for discharge or other penalty upon an employee |
11 | for refusing to work at the horse racing, dog racing, or jai alai event upon any of the Sundays and |
12 | holidays enumerated in this chapter, and nothing contained in this chapter shall prohibit any person |
13 | from engaging in or being employed in connection with the holding or operation of the licensed |
14 | event. |
15 | (b) Notwithstanding any terms of a lawful collective bargaining agreement entered into |
16 | prior to the effective date of this subsection, laborers, mechanics, and workers engaged in duties |
17 | requiring principally physical exertion, who are required to work on Sundays and/or holidays shall |
18 | be paid by their employers at least one and one-half (1½) times the normal rate of pay for the work |

2 | SECTION 2. This act shall take effect upon passage. |

1 | This act would provide notwithstanding the terms of any existing contract, all laborers, |
2 | mechanics, and workers engaged in duties requiring principally physical exertion, who are required |
3 | to work on Sundays and/or holidays shall be paid by their employers at least one and one-half (1½) |
4 | times the normal rate of pay. |
5 | This act would take effect upon passage. |
