RELATING TO PUBLIC OFFICERS AND EMPLOYEES -- INSURANCE BENEFITS | |

It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Section 36-12-7 of the General Laws in Chapter 36-12 entitled "Insurance |
2 | Benefits" is hereby amended to read as follows: |
3 | 36-12-7. Eligibility for benefits. |
4 | (a) All persons in the service of the state on and after July 1, 1960, whether elected, |
5 | appointed or employed, and private employees at nursing homes, developmental disability and |
6 | home care providers whose salaries are ninety percent (90%) funded with state or federal monies, |
7 | who elect to participate in an insurance contract or contracts shall be eligible to participate therein. |
8 | The director, however, with the consent of the insurance company or companies, may by rule or |
9 | regulation exclude those classes of temporary, part-time, or intermittent employees for whom |
10 | insurance contracts shall be deemed to be impracticable. |
11 | (b) The director, with the consent of the insurance company or companies, may authorize |
12 | the inclusion in insurance contracts of employees of public authorities, full-time employees of |
13 | organizations representing state employees, private employees at nursing homes, developmental |
14 | disability and home care providers whose salaries are ninety percent (90%) funded with state or |
15 | federal monies, or other appropriate agencies of the state as may be designated in the rules or |
16 | regulations of the director, and may prescribe the rate of contribution required from such |
17 | participating authorities, or other agencies. |
18 | (c) Private employees listed in subsection (a) of this section who are eligible to opt into the |
19 | state healthcare plan shall have the insurance premium deducted from their earnings with the |

1 | private employer having the option to contribute to pay all or a portion of the premium payment. |
2 | SECTION 2. This act shall take effect upon passage. |

1 | This act would allow private employees at nursing homes, developmental disability and |

3 | to be eligible to opt into the state healthcare plan. The premium payments would be the |
4 | responsibility of the employee with the employer having the option to pay all or a portion of the |
5 | insurance premium. |
6 | This act would take effect upon passage. |
