It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Chapter 40-8 of the General Laws entitled "Medical Assistance" is hereby |
2 | amended by adding thereto the following section: |
3 | 40-8-6.2. Recertification requirements - Information required. |
4 | Whenever the department of human services shall be required or take action to recertify a |
5 | Medicaid recipient, the department shall ensure that the recipient's most recent up-to-date contact |
6 | information is in the department's possession by using the National Change of Address Database |
7 | maintained by the United State Postal Service, other public program information, or other reliable |
8 | sources of contact information. Furthermore, the department may not disenroll a recipient on the |
9 | basis of returned mail, and may only disenroll a recipient after the department has successfully |
10 | contacted or made a good faith effort to contact an individual using more than one communication |
11 | mode to include, but not limited to: mail; phone; text; or email. |
12 | SECTION 2. This act shall take effect upon passage. |
