It is enacted by the General Assembly as follows:  | |
1  | SECTION 1. Section 41-1-1 of the General Laws in Chapter 41-1 entitled "Division of  | 
2  | Gaming and Athletics Licensing" is hereby amended to read as follows:  | 
3  | 41-1-1. Division of gaming and athletics licensing — Duties.  | 
4  | Within the department of business regulation there shall be a division of gaming and  | 
5  | athletics licensing. The division shall supervise the enforcement of all laws relating to the regulation  | 
6  | and control of racing and athletics, and may in the first instance make decisions and issue orders,  | 
7  | subject to appeal to the racing and athletics hearing board. The division shall exercise all powers  | 
8  | and duties prescribed by chapters 3, 3.1, 4, 5, 7, and 11 of this title, and all other acts relative to the  | 
9  | regulation and supervision of horse racing, dog racing, and athletics, heretofore performed by the  | 
10  | commission on horse racing and athletics. The division shall comply with § 42-14-14 in the conduct  | 
11  | of any investigation related to any license application, permit and/or registration related to chapters  | 
12  | 3, 3.1, 4, 7, and 11 of this title. The division may comply with § 42-14-14 in the conduct of any  | 
13  | investigation related to any license application, permit and/or registration related to chapters 5 and  | 
14  | 5.2 of this title. The investigation shall require the applicant to apply to the bureau of criminal  | 
15  | identification of the Rhode Island state police or the Rhode Island department of the attorney  | 
16  | general for a nationwide criminal records check with fingerprinting. The applicant shall be  | 
17  | responsible for payment of the costs of the criminal records check. The Rhode Island state police  | 
18  | or the Rhode Island department of the attorney general, as applicable, shall send the results of the  |

1  | criminal records check shall be sent to the division. Once the results are sent to and received by the  | 
2  | Rhode Island lottery, the Rhode Island state police and the Rhode Island department of attorney  | 
3  | general shall promptly destroy the fingerprint record(s). On or before February 1, 2011, the agency  | 
4  | shall adopt rules and regulations establishing criteria to be used in determining whether, based upon  | 
5  | a criminal records check, an application will be approved.  | 
6  | SECTION 2. This act shall take effect upon passage.  |

1  | This act would remove the requirement that the Rhode Island state police or the department  | 
2  | of attorney general complete the nationwide criminal records check for any license application,  | 
3  | permit and/or registration and require the applicant to apply for a nationwide criminal records check  | 
4  | with fingerprinting and submission to the division of gaming and athletics.  | 
5  | This act would take effect upon passage.  |
