It is enacted by the General Assembly as follows: | |
1 | SECTION 1. Legislative purpose. The purpose of this legislation is to: |
2 | (1) Allow for all citizens of Rhode Island to have to opportunity to sell home processed |
3 | foods; |
4 | (2) Increase the availability of and satisfy public demand for affordable, fresh, and locally- |
5 | produced foods; and |
6 | (3) Foster small businesses and economic growth. |
7 | SECTION 2. Sections 21-27-1 and 21-27-6.1 of the General Laws in Chapter 21-27 entitled |
8 | "Sanitation in Food Establishments" are hereby amended to read as follows: |
9 | 21-27-1. Definitions. |
10 | Unless otherwise specifically provided in this chapter, the following definitions apply to |
11 | this chapter: |
12 | (1) "Approved" means approved by the director. |
13 | (2) "Commissary" means a central processing establishment where food is prepared for |
14 | sale or service off the premises or by mobile vendor. |
15 | (3) "Department" means the department of health. |
16 | (4) "Director" means the director of health or the director's duly appointed agents. |
17 | (5) "Farmers market" means a market where two (2) or more farmers are selling produce |
18 | exclusively grown on their own farms or home food producers are selling home food products on |
| |
1 | a retail basis to consumers. Excluded from this term is any market where farmers or others are |
2 | selling produce at wholesale and/or any market in which any individual is selling produce not |
3 | grown on his or her own farm. |
4 | (6) "Farm home Home food manufacture" means the production in accordance with the |
5 | requirements of § 21-27-6.1 of food for retail sale in a residential kitchen on a farm which produces |
6 | agricultural products for human consumption and the operator of which is eligible for exemption |
7 | from the sales and use tax in accordance with § 44-18-30(32). |
8 | (7) "Food" means: (i) articles used for food or drink for people or other animals, (ii) |
9 | chewing gum, and (iii) articles used for components of any food or drink article. |
10 | (8) "Food business" means and includes any establishment or place, whether fixed or |
11 | mobile, where food or ice is held, processed, manufactured, packaged, prepared, displayed, served, |
12 | transported, or sold. |
13 | (9) "Food service establishment" means any fixed or mobile restaurant, coffee shop, |
14 | cafeteria, short-order cafe, luncheonette, grill, tearoom, sandwich shop, soda fountain, tavern; bar, |
15 | cocktail lounge, night club, roadside stand, industrial feeding establishment, cultural heritage |
16 | education facility, private, public or nonprofit organization or institution routinely serving food, |
17 | catering kitchen, commissary or similar place in which food or drink is prepared for sale or for |
18 | service on the premises or elsewhere, and any other eating or drinking establishment or operation |
19 | where food is served or provided for the public with or without charge. |
20 | (10) "Mobile food service unit" means a unit that prepares and/or sells food products for |
21 | direct consumption. |
22 | (11) "Person" means any individual, firm, co-partnership, association, or private or |
23 | municipal corporation. |
24 | (12) "Processor" means one who combines, handles, manufactures or prepares, packages, |
25 | and stores food products. |
26 | (13) "Operator" in relation to food vending machines means any person who by contract, |
27 | agreement, lease, rental, or ownership sells food from vending machines. |
28 | (14) "Retail" means when eighty percent (80%) or more of sales are made directly to |
29 | consumers. |
30 | (15) "Retail peddler" means a food business which sells meat, seafood, and dairy products |
31 | directly to the consumer, house to house or in a neighborhood. |
32 | (16) "Roadside farmstand" means a stand or location adjacent to a farm where produce |
33 | grown only on that farm is sold at the time of harvest. |
34 | (17) "Vending machine site or location" means the room, enclosure, space, or area where |

1 | one or more vending machines are installed and/or operated. |
2 | (18) "Warehouse" means a place for the storage of dried, fresh, or frozen food or food |
3 | products, not including those areas associated within or directly part of a food service establishment |
4 | or retail market. |
5 | (19) "Wholesale" means when eighty percent (80%) or more of the business is for resale |
6 | purposes. |
7 | (20) "Cultural heritage education facility" means a facility for up to ten (10) individuals |
8 | who, for a fee, participate in the preparation and consumption of food, limited to an owner-occupied |
9 | site documented to be at least one hundred fifty (150) years old and whose drinking water shall be |
10 | obtained from an approved source which meets all of the requirements of chapter 46-13. |
11 | 21-27-6.1. Farm home food manufacture Home food manufacture. |
12 | (a) As used in this section, the following words and terms shall have the following |
13 | meanings: |
14 | (1) "Cottage food producer" or "producer” means the person who produces a home-based |
15 | food product. |
16 | (2) "Delivered" means transferred to the consumer, either immediately upon sale or at a |
17 | time thereafter. |
18 | (3) "Department" means the department of health. |
19 | (4) "Home" means a dwelling, including an apartment or other leased space, where a |
20 | cottage food producer resides. |
21 | (5) "Home food product" made food item means a food item that is non-potentially |
22 | hazardous, prepared in a residential kitchen. |
23 | (6) "Non-potentially hazardous," in relation to food, means food that does not require |
24 | time/temperature control for safety to limit pathogenic microorganism growth or toxin formation. |
25 | (7) "Potentially hazardous," in relation to food, means food that requires time/temperature |
26 | control for safety to limit pathogenic microorganism growth or toxin formation. |
27 | (b) Notwithstanding the other provisions of this chapter, the department of health shall |
28 | permit farm home food manufacture and the sale of the products of farm home food manufacture |
29 | at farmers' markets, farmstands, and other markets and stores operated by farmers for the purpose |
30 | of the retail sale of the products of Rhode Island farms direct to consumers, including at venues |
31 | such as farmers’ markets, public events, roadside stands, or at any location agreed upon by the |
32 | producer and consumer, from the home, whether by pickup or delivery, through online venues and |
33 | through mail order sales, provided that the requirements of this section are met. |
34 | (1) The farm home food products shall be produced in a kitchen that is on the premises of |

1 | a farm and meets the standards for kitchens as provided for in minimum housing standards, adopted |
2 | pursuant to chapter 24.2 of title 45 and the Housing Maintenance and Occupancy Code, adopted |
3 | pursuant to chapter 24.3 of title 45, and in addition the kitchen shall: |
4 | (i) Be equipped at minimum with either a two (2) compartment sink or a dishwasher that |
5 | reaches one hundred fifty (150) degrees Fahrenheit after the final rinse and drying cycle and a one |
6 | compartment sink; |
7 | (ii) Have sufficient area or facilities, such as portable dish tubs and drain boards, for the |
8 | proper handling of soiled utensils prior to washing and of cleaned utensils after washing so as not |
9 | to interfere with safe food handling; equipment, utensils, and tableware shall be air dried; |
10 | (iii) Have drain boards and food preparation surfaces that shall be of a nonabsorbent, |
11 | corrosion resistant material such as stainless steel, formica or other chip resistant, nonpitted surface; |
12 | (iv) Have self-closing doors for bathrooms that open directly into the kitchen; |
13 | (v) If farm the home is on private water supply it must be tested once per year. |
14 | (2) The farm home food products are prepared and produced ready for sale under the |
15 | following conditions: |
16 | (i) Pets are kept out of food preparation and food storage areas at all times; |
17 | (ii) Cooking facilities shall not be used for domestic food purposes while farm home food |
18 | products are being prepared; |
19 | (iii) Garbage is placed and stored in impervious covered receptacles before it is removed |
20 | from the kitchen, which removal shall be at least once each day that the kitchen is used for farm |
21 | home food manufacture; |
22 | (iv) Any laundry facilities which may be in the kitchen shall not be used during farm home |
23 | food manufacture; |
24 | (v) Recipe(s) for each farm home food product with all the ingredients and quantities listed, |
25 | and processing times and procedures, are maintained in the kitchen for review and inspection; |
26 | (vi) List ingredients on product; |
27 | (vii) Label with farm name, (or unique identification number), address and telephone |
28 | number. |
29 | (3) Farm home Home food manufacture shall be limited to the production of nonpotentially |
30 | hazardous food and foods that do not require refrigeration, including but not limited to: |
31 | (i) Jams, jellies, preserves and acid foods, such as vinegars, that are prepared using fruits, |
32 | vegetables and/or herbs that have been grown locally; |
33 | (ii) Double crust pies that are made with fruit grown locally; |
34 | (iii) Yeast breads; |

1 | (iv) Maple syrup from the sap of trees on the farm at the home of the producer or of trees |
2 | within a twenty (20) mile radius of the farm home of the producer; |
3 | (v) Candies and fudges; |
4 | (vi) Dried herbs and spices.; |
5 | (vii) Cakes, cookies, and other baked goods. |
6 | (4) Each farm home kitchen shall be registered with the department of health and shall |
7 | require a notarized affidavit of compliance, in any form that the department may require, from the |
8 | owner of the farm producer that the requirements of this section have been met and the operation |
9 | of the kitchen shall be in conformity with the requirements of this section. A certificate of |
10 | registration shall be issued by the department upon the payment of a fee as set forth in § 23-1-54 |
11 | and the submission of an affidavit of compliance. The certificate of registration shall be valid for |
12 | one year after the date of issuance; provided, however, that the certificate may be revoked by the |
13 | director at any time for noncompliance with the requirements of the section. The certificate of |
14 | registration, with a copy of the affidavit of compliance, shall be kept in the kitchen where the farm |
15 | home food manufacture takes place. The director of health shall have the authority to develop and |
16 | issue a standard form for the affidavit of compliance to be used by persons applying for a certificate |
17 | of registration; the form shall impose no requirements or certifications beyond those set forth in |
18 | this section and § 21-27-1(6). No certificates of registration shall be issued by the department prior |
19 | to September 1, 2002. |
20 | (5) Income from farm home food manufacture shall not be included in the calculation of |
21 | farm income for the purposes of obtaining an exemption from the sales and use tax pursuant to § |
22 | 44-18-30(32), nor shall any equipment, utensils, or supplies acquired for the purpose of creating or |
23 | operating farm home food manufacture be exempt from the sales and use tax as provided for in § |
24 | 44-18-30(32). |
25 | (6) Upon request by a home food manufacturer, the department shall provide to the |
26 | producer a unique identification number that the producer may use on their product label in place |
27 | of a home address. |
28 | SECTION 3. Section 23-1-54 of the General Laws in Chapter 23-1 entitled "Department |
29 | of Health" is hereby amended to read as follows: |
