A N   A C T

RELATING TO MOTOR AND OTHER VEHICLES - MISCELLANEOUS RULES

     It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 31-22 of the General Laws entitled "Miscellaneous Rules" is

hereby amended by adding thereto the following section:

     31-22-31. Parking payment evasion.

     Every person who shall fraudulently evade or attempt to evade the payment of any

parking or storage fee by refusal, stealth, deception, or unjustified failure to pay either a person or

automated payment device, shall be required to pay a fine of not less than thirty dollars ($30.00)

nor more than one hundred dollars ($100) for the first offense, and a fine of one hundred dollars

($100) for every subsequent offense, and to pay the parking amount due, along with all costs to

repair any mechanical devices damaged or destroyed while attempting to evade payment, and an

administrative fee of thirty dollars ($30.00). A parking payment evader under this section shall

receive a traffic violation summons which shall be subject to the jurisdiction of the traffic

tribunal. The administrative fee due under this section shall be remitted to the city or town in

which the evasion occurred.

     SECTION 2. This act shall take effect upon passage.
