It is enacted by the General Assembly as follows: | |
|

SECTION 1. Title 45 of the General Laws entitled "TOWNS AND CITIES" is hereby |
|

amended by adding thereto the following chapter: |

HOPKINS HILL FIRE DISTRICT |
|
1-5 |
45-66-1. Tax classification. -- (a) Effective May 4, 2013, the Hopkins Hill fire district |
|
1-6 |
may adopt a tax classification plan by a majority vote of the electors at the Hopkins Hill fire |
|
1-7 |
district annual meeting, subject to the following limitations: |
|
1-8 |
(1) The designated classes of property shall be limited to the two (2) classes, as defined in |
|
1-9 |
subsection (b) of this section. |
|
1-10 |
(2) The effective tax rate applicable to any class shall not exceed by fifty percent (50%) |
|
1-11 |
the rate applicable to any other class. |
|
1-12 |
(b) Classes of property: |
|
1-13 |
(1) Class 1: Residential real estate consisting of no more than five (5) dwelling units, land |
|
1-14 |
classified as open space, and dwellings on leased land including mobile homes. |
|
1-15 |
(2) Class 2: Commercial and industrial real estate, residential properties containing partial |
|
1-16 |
commercial or businesses uses and residential real estate of more than five (5) dwelling units. |

45-66-2. Hopkins Hill fire district annual appropriation. -- Effective May 4, 2013, if |
|
1-18 |
the Hopkins Hill fire district fails to approve an annual appropriation authorization, the same |
|
1-19 |
amounts appropriated in the prior fiscal year shall be made available at the same levy and tax rate |
|
1-20 |
as the prior annual appropriation. |
|
2-1 |
SECTION 2. This act shall take effect upon passage. |

This act would authorize the Hopkins Hill fire district to adopt a two-tiered tax |

classification plan. It would authorize the Hopkins Hill fire district to operate under the prior |

year's authorized appropriation, if it fails to approve an annual appropriation authorization. |

3-4 |
This act would take effect upon passage. |
