RELATING TO TOWNS AND CITIES -- CENTRAL COVENTRY FIRE DISTRICT | |

It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Title 45 of the General Laws entitled "TOWNS AND CITIES" is hereby |
|

amended by adding thereto the following chapter: |
|

     CHAPTER 66 |
|

CENTRAL COVENTRY FIRE DISTRICT |
|
1-5 |
     45-66-1. Tax classification. -- (a) Effective September 1, 2012, the Central Coventry fire |
|
1-6 |
district may adopt a tax classification plan, subject to the following limitations: |
|
1-7 |
     (1) The designated classes of property shall be limited to the two (2) classes, as defined in |
|
1-8 |
subsection (b) of this section. |
|
1-9 |
     (2) The effective tax rate applicable to any class shall not exceed by fifty percent (50%) |
|
1-10 |
the rate applicable to any other class. |
|
1-11 |
     (b) Classes of property: |
|
1-12 |
     (1) Class 1: Residential real estate consisting of no more than five (5) dwelling units, land |
|
1-13 |
classified as open space, and dwellings on leased land including mobile homes. |
|
1-14 |
     (2) Class 2: Commercial and industrial real estate, residential properties containing partial |
|
1-15 |
commercial or businesses uses and residential real estate of more than five (5) dwelling units. |
|
1-16 |
     45-66-2. Central Coventry fire district annual appropriation. -- Effective September |
|
1-17 |
1, 2012, if the Central Coventry fire district fails to approve an annual appropriation |
|
1-18 |
authorization, the same amounts appropriated in the prior fiscal year shall be available; provided, |
|
1-19 |
that such appropriation shall be increased by such amount as is necessary for the payment of |
|
1-20 |
existing bonded indebtedness of the Central Coventry fire district and interest thereon. |

2-1 |
     SECTION 2. This act shall take effect upon passage and shall apply retroactively to |
|

September 1, 2012 and shall be repealed on September 1, 2013. |

     This act would authorize the Central Coventry fire district to adopt a two-tiered tax |
|

classification plan. It would authorize the Central Coventry fire district to operate under the prior |
|
3-3 |
year's authorized appropriation, if it fails to approve an annual appropriation authorization. |
|
3-4 |
Finally, it would allow the Central Coventry fire district to increase the prior year's authorized |
|
3-5 |
appropriation in an amount necessary to make the required payments on the fire district's bond |
|
3-6 |
indebtedness plus interest. |
|
3-7 |
     This act would take effect upon passage and would apply retroactively to September 1, |
|
3-8 |
2012 and would be repealed on September 1, 2013. |
