A N A C T

RELATING TO LABOR AND LABOR RELATIONS - ARBITRATION - CONTINUING OF

CONTRACTUAL PROVISIONS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 28-9.1-17 of the General Laws in Chapter 28-9.1 entitled

"Firefighters' Arbitration" is hereby amended to read as follows:

     28-9.1-17. Continuance of contractual provisions. -- All contractual provisions

contained in a collective bargaining agreement entered into pursuant to the provisions of this

1-5

chapter shall continue in the following collective bargaining agreement unless either the

1-6

bargaining agent or the corporate authority shall, in writing, within the thirty (30) day period

1-7

referred to in section 28-9.1-7, propose a change in any contractual provision. until such time as a

1-8

successor agreement has been reached between the parties or an interest arbitration award has

1-9

been rendered.

     SECTION 2. Section 28-9.2-17 of the General Laws in Chapter 28-9.2 entitled

"Municipal Police Arbitration" is hereby amended to read as follows:

     28-9.2-17. Continuance of contractual provisions. -- All contractual provisions

contained in a collective bargaining agreement entered into pursuant to the provisions of this

1-14

chapter shall continue in the following collective bargaining agreement unless either the

1-15

bargaining agent or the corporate authority shall, in writing, within the thirty (30) day period

referred to in section 28-9.2-7, propose a change in any contractual provisions. until such time as

a successor agreement has been reached between the parties or an interest arbitration award has

been rendered.

     SECTION 3. Chapter 28-9.3 of the General Laws entitled "Certified School Teachers'

Arbitration" is hereby amended by adding thereto the following section:

     28-9.3-17. Continuance of contractual provisions. -- All contractual provisions

contained in a collective bargaining agreement entered into pursuant to the provisions of this

chapter shall continue until such time as a successor agreement has been reached between the

2-24

parties.

     SECTION 4. Chapter 28-9.4 of the General Laws entitled "Municipal Employees'

2-26

Arbitration" is hereby amended by adding thereto the following section:

     28-9.4-20. Continuance of contractual provisions. -- All contractual provisions

2-28

contained in a collective bargaining agreement entered into pursuant to the provisions of this

2-29

chapter shall continue until such time as a successor agreement has been reached between the

2-30

parties.

     SECTION 5. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would require that contractual provisions contained in a collective bargaining

agreement with the certified school teachers, municipal employees, firefighters and municipal

police will continue until a successor agreement is reached or an interest arbitration award is

rendered.

     This act would take effect upon passage.
