A N A C T

RELATING TO ADJUDICATION OF TRAFFIC OFFENSES - SURCHARGE FOR

HIGHWAY REPAIR

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 31-41.1 of the General Laws entitled "Adjudication of Traffic

Offenses" is hereby amended by adding thereto the following section:

     31-41.1-12. Highway repair surcharge. – Upon the disposition of any complaint

brought pursuant to the applicable provisions of Title 31, sustaining the violation, there shall be

1-5

assessed a five dollar ($5.00) fee which shall be paid forthwith to the department of transportation

1-6

for the sole purpose of funding the cost of highway repair and maintenance.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would establish a surcharge of five dollars ($5.00) on the payment of traffic

offenses to be paid over to the Department of Transportation to fund highway repair and

     This act would take effect upon passage.
