RELATING TO TAXATION - LEVY AND ASSESSMENT OF LOCAL TAXES | |

It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Chapter 39-3 of the General Laws entitled "Regulatory Powers of |
|

Administration" is hereby amended by adding thereto the following section: |
|

     39-3-45. Service requirements offered by telephone companies. – To the extent that a |
|
1-4 |
telephone company is required to offer a local exchange service in any exchange or other |
|
1-5 |
geographic area or to any customer upon request, such company may satisfy such requirement by |
|
1-6 |
offering any service that includes, at a minimum, access to E911 and the ability to make and |
|
1-7 |
receive voice telephone calls, through the use of any available technology, including, but not |
|
1-8 |
limited to, wireless service or VoIP service, without thereby subjecting any such technology or |
|
1-9 |
service to any greater regulation than would otherwise apply to it; provided, however, that the |
|
1-10 |
price of such service together with any required fees and charges shall not exceed the price the |
|
1-11 |
company charges for traditional telephone service, including any required fees and charges. |
|
1-12 |
     SECTION 2. This act shall take effect upon passage. |
