RELATING TO STATE AFFAIRS AND GOVERNMENT - HEALTH CARE FOR CHILDREN

AND PREGNANT WOMEN

It is enacted by the General Assembly as follows:

     SECTION 1. Section 42-12.3-7 of the General Laws in Chapter 42-12.3 entitled "Health

Care for Children and Pregnant Women" is hereby amended to read as follows:

     42-12.3-7. Financial contributions. – (a) The department of human services may require

the payment of enrollment fees, sliding fees, deductibles, co-payments, and/or other contributions

1-5

based on ability to pay. These fees shall be established by rules and regulations to be promulgated

1-6

by the department of human services or the department of health, as appropriate.

     (b) Provided, that a co-payment is hereby established for emergency room visits and

1-8

urgent care visits for all recipients of the Rite Share/Rite Care Program benefits in the amount of

1-9

five dollars ($5.00).

     SECTION 2. This act shall take effect upon passage.
