RELATING TO TOWNS AND CITIES -- SUBDIVISION OF LAND | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Section 45-23-33 of the General Laws in Chapter 45-23 entitled |

"Subdivision of Land" is hereby amended to read as follows: |

     45-23-33. General provisions -- Required contents of local regulations. -- (a) The |
1-4 |
local regulations consist of the regulations and other text, together with charts, graphs, appendices |
1-5 |
and other explanatory material. All local regulations include, at a minimum, the elements listed |
1-6 |
below and as further described in this chapter: |
1-7 |
      (1) Statement of enabling authority for land development and subdivision derived from |
1-8 |
section 45-23-25 et seq.; |
1-9 |
      (2) Statement of the city or town enabling ordinance as specified in section 45-23-51; |
1-10 |
      (3) Statement of purpose and consistency with the comprehensive plan, the zoning |
1-11 |
ordinance and other federal, state and local land use regulations; |
1-12 |
      (4) Definitions; |
1-13 |
      (5) General provisions; |
1-14 |
      (6) Special provisions; |
1-15 |
      (7) Procedures for review and approval of plats and plans; |
1-16 |
      (8) Procedures for recording of plats and plans; |
1-17 |
      (9) Procedures for guarantees of public improvements; |
1-18 |
      (10) Procedures for waivers and modifications; |
1-19 |
      (11) Procedures for enforcement and penalties; |
2-20 |
      (12) Procedures for the adoption of the regulations and amendments; |
2-21 |
      (13) Procedures for the administration of the regulations and amendments; |
2-22 |
      (14) Procedures for appeals; |
2-23 |
      (15) Design and public improvement standards for all districts within the municipality; |
2-24 |
      (16) Construction specifications for improvement standards; and |
2-25 |
      (17) Specification of all application documents and other documents to be submitted at |
2-26 |
each stage of the development process. |
2-27 |
     (b) The board shall not have the authority to require additional information and |
2-28 |
documents other than those specifically enumerated in the local regulations for the associated |
2-29 |
stage of the project, nor to adopt a local regulation empowering it to request additional |
2-30 |
information not set forth specifically in the local regulations. |
2-31 |
     SECTION 2. This act shall take effect upon passage. |
