RELATING TO STATE AFFAIRS AND GOVERNMENT - ADMINISTRATION OF STATE

DEPARTMENTS

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 42-20 of the General Laws entitled "Administration of State

Departments" is hereby amended by adding thereto the following section:

     42-20-17. Implementation of rules and regulations. – (a) Whenever, pursuant to

statute, any state agency is required to promulgate rules and regulations, said state agency shall

1-5

promulgate said rules and regulations within ninety (90) days of the enactment of the statute.

     (b) Upon promulgation of rules and regulations pursuant to this section, the director of

the state agency shall cause a copy of such rules and regulations to be delivered to the clerk of the

1-8

house of representatives oversight committee and the clerk of the senate oversight committee.

Upon delivery in accordance with this section, said rules and regulations shall have immediate

1-10

effect; provided, however, that they will not have permanent effect until ratified by an act of the

1-11

general assembly.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would require state agencies which are required by statute to promulgate rules

and regulations to do so within ninety (90) days of the enactment of the requiring statute. This act

would also require that the general assembly ratify said rules and regulations.

     This act would take effect upon passage.
