It is enacted by the General Assembly as follows: | |
|

     SECTION 1. Chapter 28-44 of the General Laws entitled "Employment Security - |
|
1-2 |
Benefits" is hereby amended by adding thereto the following section: |
|

     28-44-71. Report. – The department of labor and training ("the department") shall |
|
1-4 |
develop a report that presents options for adjusting and creating state unemployment insurance |
|
1-5 |
laws regarding employees, employers, and industries of a seasonal nature. The department is |
|
1-6 |
authorized to gather and/or receive information from any interested parties in developing the |
|
1-7 |
report. The report shall include options for relevant definitions, including, but not limited to, |
|
1-8 |
"seasonal employees", "seasonal employers", "seasonal industries", and "operating period". The |
|
1-9 |
department shall examine legislation proposed and/or enacted in other states and examine and |
|
1-10 |
report the potential impact on Rhode Island if those proposals and/or enactments were adopted in |
|
1-11 |
Rhode Island. The department shall provide the governor and general assembly with options for |
|
1-12 |
the current unemployment benefit structure related to seasonal employment that are in accordance |
|
1-13 |
with federal rules and guidelines and the corresponding impacts of the proposed options within |
|
1-14 |
the unemployment insurance program. The department shall provide the report to the governor, |
|
1-15 |
speaker of the house and senate president no later than December 1, 2013. |

     SECTION 2. This act shall take effect upon passage. |
