A N A C T

RELATING TO HEALTH AND SAFETY -- REFUSE DISPOSAL

     Introduced By: Representatives McLaughlin, Hull, Silva, McNamara, and Lombardi

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 23-18.9 of the General Laws entitled "Refuse Disposal" is hereby

amended by adding thereto the following section:

     23-18.9-1.1. Refuse disposal generally. -- Any private contractor who is under contract

with a city or town to pick up trash and recyclable materials, shall place the empty containers near

the pickup area in a safe and orderly manner. Any person or entity who violates this section shall

1-6

be subject to a fine of one hundred dollars ($100) per incident. The jurisdiction of said violation

1-7

shall be in the local municipal court or in the county wherein the city or town is located if there is

1-8

no municipal court, in said city or town.

     SECTION 2. This act shall take effect upon passage.

     This act would require private contractors who pick up trash and recyclable materials to
