A N A C T

VALIDATING AND RATIFYING AMENDMENTS TO THE HOME RULE CHARTER OF

THE TOWN OF NORTH KINGSTOWN

It is enacted by the General Assembly as follows:

     SECTION 1. Validation of 2010 amendments. In all respects in which the amendments to

the Home Rule Charter of the town of North Kingstown, which amendments were adopted and

approved by the electors of the town of North Kingstown on November 2, 2010, may require

1-4

ratification, confirmation, validation or enactment by the general assembly, but in no other

1-5

respects, the provisions of said amendments to the Home Rule Charter of the town of North

1-6

Kingstown are hereby ratified, confirmed, validated and enacted. It is the express intention of the

1-7

general assembly, by passage of this act, to give effect to, ratify, confirm, validate and enact those

1-8

provisions of the said amendments to the Home Rule Charter of the town of North Kingstown

1-9

which require ratification, confirmation, validation or enactment and by the passage of this act,

1-10

the legislature does hereby ratify, confirm, validate and enact said provisions, but nothing in this

1-11

act shall be construed to abrogate or impair the powers now or hereafter granted to towns by the

1-12

Home Rule amendment and other applicable laws of the state of Rhode Island or those rights

1-13

retained by said town of North Kingstown in its Home Rule Charter.

     SECTION 2. Validation of 2012 amendments. In all respects in which the amendments to

the Home Rule Charter of the town of North Kingstown, which amendments were adopted and

1-16

approved by the electors of the town of North Kingstown on November 6, 2012, may require

1-17

ratification, confirmation, validation or enactment by the general assembly, but in no other

1-18

respects, the provisions of said amendments to the Home Rule Charter of the town of North

1-19

Kingstown are hereby ratified, confirmed, validated and enacted. It is the express intention of the

general assembly, by passage of this act, to give effect to, ratify, confirm, validate and enact those

provisions of the said amendments to the Home Rule Charter of the town of North Kingstown

which require ratification, confirmation, validation or enactment and by the passage of this act,

the legislature does hereby ratify, confirm, validate and enact said provisions, but nothing in this

act shall be construed to abrogate or impair the powers now or hereafter granted to towns by the

Home Rule amendment and other applicable laws of the state of Rhode Island or those rights

retained by said town of North Kingstown in its Home Rule Charter.

     SECTION 3. If any provisions of this act, or application thereof to the town of North

Kingstown or to any person or circumstances is deemed invalid for any reason, the remainder of

2-10

this act or the application of such provision to said town or other persons or circumstances shall

2-11

not be affected thereby, and to this end the provisions of this act are declared to be severable.

     SECTION 4. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

VALIDATING AND RATIFYING AMENDMENTS TO THE HOME RULE CHARTER OF

THE TOWN OF NORTH KINGSTOWN

     This act would ratify the amendments to the Home Rule Charter of the town of North

Kingstown passed by the electors in 2010 and 2012.

     This act would take effect upon passage.
