RELATING TO BUSINESSES AND PROFESSIONS - AUTOMOBILE BODY REPAIR

SHOPS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 5-38-28 of the General Laws in Chapter 5-38 entitled "Automobile

Body Repair Shops" is hereby amended to read as follows:

     5-38-28. Repair certification. -- The automobile body repair shop shall include in the

documentation of each repair, a repair bill executed by the automobile body repair shop and

certifying under the penalties of perjury, the repairs to a particular vehicle that have actually been

1-6

made. The automobile body repair shop shall document any agreement with a consumer whereby

1-7

repairs detailed in an appraisal, and paid for by an insurer have not been made. The automobile

1-8

body repair shop shall make these documents available to the insurer upon request as a condition

1-9

of payment for the repair.

     SECTION 2. This act shall take effect upon passage.

     This act would require auto body repair shops to document any agreement with a

This act would also require auto body repair shops to make such documents available to the
