It is enacted by the General Assembly as follows: | |

     SECTION 1. Section 6-13.1-16 of the General Laws in Chapter 6-13.1 entitled |

"Deceptive Trade Practices" is hereby amended to read as follows: |

     6-13.1-16. Disclosure of service contract agreements. -- (a) It shall be a deceptive trade |
1-4 |
practice in violation of this chapter for any service contractor to fail to disclose to any person who |
1-5 |
is a prospective customer, at the time that the person makes initial contact by any means with the |
1-6 |
service contractor, that a service call made by the service contractor to the home or business of |
1-7 |
the prospective customer will require the payment by the prospective customer of separate, |
1-8 |
distinct, and itemized fees for the following: |
1-9 |
      (1) Service charge -- the fee charged by the service contractor to respond to the request |
1-10 |
for service. |
1-11 |
      (2) Labor charge. |
1-12 |
      (3) Parts and materials. |
1-13 |
      (b) As used in this section: |
1-14 |
      (1) "Service contractor" means a person engaged in the business of repairing, |
1-15 |
overhauling, adjusting, assembling, or disassembling consumer goods. |
1-16 |
      (2) "Person" means a natural person, corporation, trust, partnership, incorporated or |
1-17 |
unincorporated association, and any other legal entity. |
2-18 |
     SECTION 2. This act shall take effect upon passage. |
