RELATING TO MOTOR AND OTHER VEHICLES - DEALERS', MANUFACTURERS' AND | |
RENTAL LICENSES | |

It is enacted by the General Assembly as follows: | |

     SECTION 1. Sections 31-5-7, 31-5-8, 31-5-22 and 31-5-34 of the General Laws in |

Chapter 31-5 entitled "Dealers', Manufacturers', and Rental Licenses" are hereby amended to read |

as follows: |
1-4 |
     31-5-7. Duration of license. -- Application for license shall be made to the department. |
1-5 |
Licenses shall be valid, unless sooner revoked or suspended, until December 31st of each year for |
1-6 |
one year and shall be renewable on or before expiration, upon application and payment of the fee |
1-7 |
required by this chapter. |
1-8 |
     Commencing January 1, 2014, licenses shall be valid, unless sooner revoked or |
1-9 |
suspended, until December 31, 2016 and shall be renewable thereafter every three (3) years. |
1-10 |
     31-5-8. License fee. -- The license fee for each year shall be as follows: the fee for the |
1-11 |
license to each motor vehicle dealer shall be three hundred dollars ($300) plus a fee in like |
1-12 |
amount for each office or branch. |
1-13 |
     Commencing January 1, 2014 the license fee for the three (3) year license duration shall |
1-14 |
be nine hundred dollars ($900) payable in installments of three hundred dollars ($300) per year. |

     31-5-22. Application for license -- Fee -- Expiration. -- (a) Any person desiring to be |
1-16 |
licensed as a manufacturer, factory representative, or distributor shall apply to the department of |
1-17 |
revenue upon a form containing any information that the department shall require. The |
1-18 |
department may require with the application or, otherwise, information relating to the applicant's |
1-19 |
solvency, his or her financial standing, or other pertinent matter commensurate with the |
2-1 |
safeguarding of the public interest, all of which may be considered by the department in |
2-2 |
determining the fitness of the applicant to engage in the business for which the applicant desires |
2-3 |
the license. |

      (b) Each application of a factory representative shall be accompanied by a fee of one |
2-5 |
hundred dollars ($100). Commencing January 1, 2014 the factory representative license fee for |
2-6 |
the three (3) year license duration shall be three hundred dollars ($300) and shall be payable in |
2-7 |
installments of one hundred dollars ($100) per year. Each application of a manufacturer or |
2-8 |
distributor shall be accompanied by a fee of three hundred dollars ($300). Commencing January |
2-9 |
1, 2014 the manufacturers or distributors license fee for the three (3) year license duration shall |
2-10 |
be nine hundred dollars ($900) and shall be payable in installments of three hundred dollars |
2-11 |
($300) per year. |

      (c) All licenses shall be granted or refused within thirty (30) days after the application is |
2-13 |
filed and shall expire, unless revoked or suspended before that time, on December 31st of the |
2-14 |
calendar year for which they are granted. Commencing January 1, 2014, licenses shall be valid, |
2-15 |
unless sooner revoked or suspended, until December 31, 2016 and shall be renewable thereafter |
2-16 |
every three (3) years. |

     31-5-34. Application for license -- Fee -- Expiration. -- (a) Any person, firm, or |
2-18 |
corporation requiring a license pursuant to this chapter shall apply to the department upon a form |
2-19 |
specifying any information that the department shall require. The department may require with an |
2-20 |
application, or otherwise, information relating to the applicant's solvency, his or her or its |
2-21 |
financial standing, or any other matter which the department may deem pertinent to safeguard the |
2-22 |
public interest, all of which may be considered by the department in determining the fitness of the |
2-23 |
applicant to be licensed pursuant to this chapter. Each application shall be accompanied by a fee |

      (b) Notwithstanding the provisions of any general or public law to the contrary, the |
2-32 |
authority to issue licenses for the rental or leasing of motorized bicycles and/or motorized |
2-33 |
tricycles in the town of New Shoreham shall be vested exclusively in the town council of the |
2-34 |
town of New Shoreham pursuant to the provisions of chapter 19.3 of title 31. |

     SECTION 2. This act shall take effect upon passage. |

     This act would allow dealers, manufacturers, distributors and leasing companies to renew |

their licenses every three years instead of renewing every year. License fees remain unchanged |

but are allowed to be paid on a yearly basis. |
