RELATING TO CRIMINAL OFFENSES - THREATS AND EXTORTION | |

It is enacted by the General Assembly as follows: | |
|

SECTION 1. Chapter 11-42 of the General Laws entitled "Threats and Extortion" is |
|

hereby amended by adding thereto the following section: |
|

11-42-4.1. Threats to commit serious bodily harm to persons on school property. -- |
|
1-4 |
(a) Whoever knowingly and willfully delivers or conveys, directly or indirectly, a verbal or |
|
1-5 |
written threat to take the life of, or to inflict bodily harm, and the threat would place the person |
|
1-6 |
who is the object of the threat in reasonable apprehension of death or bodily harm, and such threat |
|
1-7 |
is: |
|
1-8 |
(1) On the grounds or premises of any elementary, middle, or secondary school property; |
|
1-9 |
(2) At any elementary, middle, or secondary school-sponsored event; or |
|
1-10 |
(3) On a school bus to any person or persons, regardless of whether the person who is the |
|
1-11 |
object of the threat actually receives the threat, shall be guilty of a felony and shall be imprisoned |
|
1-12 |
for not more than five (5) years, or fined not more than five thousand dollars ($5,000), or both. |
|
1-13 |
(b) For purposes of this section, an electronically transmitted communication producing a |
|
1-14 |
visual or electronic message is "written" or in writing. |
|
1-15 |
SECTION 2. This act shall take effect upon passage. |
