RELATING TO STATE AFFAIRS AND GOVERNMENT - ADMINISTRATIVE

PROCEDURES ACT

     Introduced By: Representatives Ucci, Shekarchi, Costa, Fellela, and Valencia

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 42-35 of the General Laws entitled "Administrative Procedures" is

hereby amended by adding thereto the following section

     42-35-3.6. Adoption of rules schedule. – (a) The adoption or amendment of any non-

emergency rule shall comply with the following schedule:

     (1) All proposed rules and amendments shall be published yearly in the month of

1-6

December;

1-7

     (2) Public hearings shall be held in the following month of January;

     (3) The adopted rules and amendments shall become effective no later than the following

1-9

April.

     (b) All emergency rules must be adopted and signed by the governor

1-11

     (c) Non-emergency rules may be adopted without the written consent of the governor.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would establish a rigid schedule for the covered administrative agencies to

publish and adopt rules and amendments. It would also prohibit the promulgation of an

emergency rule or amendment without the written consent of the governor.

     This act would take effect upon passage.
