A N A C T

RELATING TO MOTOR AND OTHER VEHICLES -- REGISTRATION OF VEHICLES

It is enacted by the General Assembly as follows:

     SECTION 1. Section 31-3-2.2 of the General Laws in Chapter 31-3 entitled "Registration

of Vehicles" is hereby amended to read as follows:

     31-3-2.2. Registration of motorcycles, motorized bicycles, and motorized tricycles. --

Registration of motorcycles, motorized bicycles, motorized tricycles and all-terrain vehicles.

-- (a) Every motorcycle, motorized bicycle, and motorized tricycle and all-terrain vehicles (ATV)

owned by a resident of this state shall be subject to the registration provisions of chapters 3 -- 9 of

this title whether the motorcycle, motorized bicycle, or motorized tricycle or all-terrain vehicles

1-8

(ATVs) is operated or drawn upon a highway within this state or upon private property. As used

1-9

in this section, an all-terrain vehicle (ATV) means a vehicle that travels on low-pressure tires,

1-10

with a seat that is straddled by the operator, along with handlebars for steering control. An

1-11

electric personal assistive mobility device ("EPAMD") and electric motorized bicycles shall not

1-12

be required to register under this chapter; provided, however, that an EPAMD and/or electric

1-13

motorized bicycles shall not be operated in this state by a person under the age of sixteen (16)

1-14

years.

      (b) Notwithstanding any general law to the contrary, cities and towns are empowered to

enact ordinances that permit the use and regulation of electric personal assistive mobility devices

1-17

("EPAMD").

     SECTION 2. This act shall take effect upon passage.

     This act would subject all-terrain vehicles (ATVs) to the same registration requirements

as motorcycles, motorized bicycles and motorized tricycles.
