A N A C T

RELATING TO PUBLIC PROPERTY AND WORKS - LABOR AND PAYMENT OF DEBTS

BY CONTRACTORS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 37-13-4 of the General Laws in Chapter 37-13 entitled "Labor and

Payment of Debts by Contractors" is hereby amended to read as follows:

     37-13-4. Provisions applicable to public works contracts -- Lists of subcontractors. --

All public works shall be done by contract, subject to the same provisions of law relating thereto

and to the letting thereof, which are applicable to similar contracts of the awarding authority or

authorized agency, hereinafter called the "proper authority", in the general location where the

1-7

work is to be performed and which are not contrary to the provisions of sections 37-13-1 -- 37-

1-8

13-14 and section 37-13-16. Each contractor after bidder, at least seven (7) days prior to the

award of a contract for public works shall submit to the proper authority a list of his or her

1-10

potential subcontractors of any part or all of the work. The list shall be submitted in such manner

1-11

or form as the proper authority shall uniformly require from contractors bidders in all public

1-12

works. In the event that said bidder chooses to contract with a subcontractor that was not on the

1-13

list provided to the proper authority then, prior to contracting with the subcontractor, the bidder

1-14

shall provide the name of the subcontractor to the proper authority at least seven (7) days prior to

1-15

contracting with said contractor.

     SECTION 2. This act shall take effect upon passage.

     This act would require, prior to the award of authority, that all bidders for public works

contracts provide a list of the subcontractors to be utilized.
