It is enacted by the General Assembly as follows: | |

SECTION 1. Section 31-41.1-10 of the General Laws in Chapter 31-41.1 entitled |
|

"Adjudication of Traffic Offenses" is hereby amended to read as follows: |
|

31-41.1-10. Expungement. -- (a) All violations within this title which are in the |
|
1-4 |
jurisdiction of the traffic tribunal or of a municipal court shall by operation of law, after three (3) |
|
1-5 |
years, following adjudication of the violation and after expiration of any mandatory state or |
|
1-6 |
federal record-retention period, be deleted from the records of the traffic tribunal or the municipal |
|
1-7 |
court and from the records of the division of motor vehicles. These deletions shall be in addition |
|
1-8 |
to and not in place of any expungement provided for by chapter 1.3 of title 12. |
|
1-9 |
(b) All violations of other jurisdictions which would have been within the jurisdiction of |
|
1-10 |
the traffic tribunal or of a municipal court had the violations been adjudicated within this state |
|
1-11 |
pursuant to the provisions of section 31-41.1-7 shall by operation of law, after three (3) years, |
|
1-12 |
following adjudication of the violation and after expiration of any mandatory state or federal |
|
1-13 |
record retention period, be deleted from the records of the division of motor vehicles. This |
|
1-14 |
deletion shall be in addition to and not in place of any expungement provided for by chapter 1.3 |
|
1-15 |
of title 12. |

1-16 |
SECTION 2. This act shall take effect upon passage. |

This act would allow the expungement of traffic offenses adjudicated in other |
