It is enacted by the General Assembly as follows: | |
|

SECTION 1. Chapter 42-56 of the General Laws entitled "Corrections Department" is |
|

hereby amended by adding thereto the following section: |
|

42-56-21.3. Labor of inmates during a declared state of emergency. – (a) The director |
|
1-4 |
of the department shall, upon a declaration of a state of emergency by the governor or federal |
|
1-5 |
disaster declaration by the president, pursuant to the provisions of section 30-15-9, and at such |
|
1-6 |
times and manner as the director deems proper, provide labor for the performance of emergency |
|
1-7 |
remediation projects. |
|
1-8 |
(b) Any person imprisoned at the adult correctional institution, and who is otherwise |
|
1-9 |
subject and eligible to provide labor pursuant to the provisions of section 42-56-21 shall be |
|
1-10 |
eligible. |
|
1-11 |
(c) The director of the department of corrections is hereby directed to make such |
|
1-12 |
assignments of labor to and with any other public, local, or state agency for the performance of |
|
1-13 |
emergency remediation projects as determined by the director of the department of corrections, |
|
1-14 |
working in conjunction with the director of the respective agency. |
|
1-15 |
(d) The department of corrections shall provide correctional officers to supervise all |
|
1-16 |
laborers assigned to an agency or department under the provisions of this section. |
|
1-17 |
(e) The provisions of subdivisions 42-56-21(a)(1), (2) and (3) shall apply to all labor |
|
1-18 |
supplied pursuant to this section. |

2-19 |
SECTION 2. This act shall take effect upon passage. |
