RELATING TO MOTOR AND OTHER VEHICLES -- CONSUMER ENFORCEMENT OF

USED MOTOR VEHICLE WARRANTIES

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 31-5.4 of the General Laws entitled "Consumer Enforcement of

Used Motor Vehicle Warranties" is hereby amended by adding thereto the following section:

     31-5.4-5.1. Procedure. – In addition to any dispute settlement procedure as set forth in

1-4

section 31-5.4-5, an owner or lessee of any used motor vehicle purchased or leased who fails to

conform to the applicable express or implied warranties under this chapter is eligible for

1-6

arbitration by the motor vehicle arbitration board consistent with the procedures set forth in

1-7

section 31-5.2-7.1. Such owner or lessee may either initiate a request with the department of

1-8

attorney general for arbitration by the motor vehicle arbitration board consistent with the

1-9

procedures set forth in section 31-5.2-7.1, or take part in the settlement procedure set forth in

1-10

section 31-5.4-5 if in existence.

     SECTION 2. This act shall take effect upon passage.
