RELATING TO HEALTH AND SAFETY - GENERATION - TRANSPORTATION -

STORAGE - TREATMENT - MANAGEMENT AND DISPOSAL OF REGULATED

MEDICAL WASTE

It is enacted by the General Assembly as follows:

     SECTION 1. Chapter 23-19.12 of the General Laws entitled "Generation -

Transportation - Storage - Treatment - Management and Disposal of Regulated Medical Waste" is

hereby amended by adding thereto the following section:

     23-19.12-10.1. Hospitals and pharmacies. – Notwithstanding any provision of law to

1-5

the contrary contained in any general or public law, rule or regulation, hospitals and pharmacies

1-6

shall provide for public use containers for the collection of sharps as defined in subparagraph 23-

1-7

19.12-3(7)(iii)(D).

     SECTION 2. This act shall take effect upon passage.
