RELATING TO HEALTH AND SAFETY - ELEVATORS, ESCALATORS, AND

DUMBWAITERS

It is enacted by the General Assembly as follows:

     SECTION 1. Section 23-33-5 of the General Laws in Chapter 23-33 entitled "Elevators,

Escalators, and Dumbwaiters" is hereby amended to read as follows:

     23-33-5. Permit to act as authorized inspector. – (a) The chief inspector may issue a

permit to act as an authorized inspector to: (1) any Any person holding a Qualified Elevator

1-5

Inspection (QEI) certification employed by: (1) an insurance company authorized to insure

1-6

elevators elevator devices in this state; or (2) any Any person holding a qualified mechanic’s

1-7

license in accordance with section 23-33-2.3 and having passed a written examination approved

1-8

by the chief; or

1-9

     (3) Any person, firm, or corporation engaged in the business of inspecting elevators in

1-10

this state who holds a certificate of competency, having passed a written examination approved

1-11

by the chief, or in lieu of such an examination, who holds a certificate of competency as an

1-12

inspector of elevators from a state that has a standard of examination equal to that of this state, as

1-13

determined by the chief.

     (b) A permit to act as an authorized inspector shall empower the authorized inspector to

1-15

make inspections. An authorized inspector shall not make any repairs as a result of an annual

1-16

inspection which such authorized inspector performed, except that such authorized inspector may

1-17

make a minor repair as defined by regulation through the code commission. The fee and

1-18

requirements for this permit shall be established by regulation through the code commission.

     SECTION 2. This act shall take effect upon passage.

BY THE LEGISLATIVE COUNCIL

     This act would authorize the chief inspector to issue permits to certain qualified

individuals for the inspection, repair and certification of elevators, and prohibits elevator

mechanics from inspecting their own work.

     The act would take effect upon passage.
